Sublease Agreement
This Sublease Agreement (“Sublease”) is being made between [First Name Last Name] (the “Subtenant”) and [First Name Last Name] (the “Sublessor”). The Subtenant and Sublessor may also be referred to as “Party” or together as the “Parties”.
IN CONSIDERATION OF the Subtenant renting the Premises, and the Sublessor leasing the Premises, the Parties agree to the following:
1. Premises

2. Term

3. Costs & Payment

The first rent payment must be made on [Month DD, 20YY].
Utilities: In addition to paying rent, the Subtenant also is responsible for paying all utilities or other charges associated with the Premises.
Deposit: The Subtenant will pay the Sublessor a deposit of $[XXX.00] (the “Deposit”) prior to occupying the Premises to cover the cost of damages and cleaning. If the Premises are returned in the same condition as they were when the Subtenant moved in, reasonable wear and tear expected, the Sublessor will return the Deposit. The Sublessor agrees to return the Deposit, or any remaining balance of the Deposit, within thirty (30) days of termination of the Sublease.
4. Insurance
The Subtenant must carry renter’s insurance that meets the minimum standards required under the Sublessor’s Original Lease.
5. Termination
The Sublease will automatically terminate on [Month DD, 20YY]. The Subtenant must vacate the premises with all of their belongings by [XX:00 AM/PM] on [Month DD, 20YY].
6. Assignment
The Parties may not assign the responsibilities that they have under this Sublease to anyone else unless both Parties agree to the assignment in writing.
7. Dispute Resolution
a. Legal Action and Choice of Law: If legal action is necessary, this Sublease will be interpreted based on the laws of the State of [State], regardless of any conflict of law issues that may arise. The Parties agree the legal action will be resolved in the State of [State].
b. Attorney’s Fees: The prevailing party will be able to recover its attorney’s fees and other reasonable costs for a dispute resolved by legal action.
8. Entire Agreement
This Sublease puts the Parties entire understanding in writing. This Sublease supersedes any other written or verbal communications between the Parties.
9. Severability
If any section of this Sublease is found to be invalid, illegal, or unenforceable, the rest of the Sublease will still stand.
10. Attachments
The Sublessor’s original lease (“Original Lease”) is attached. The terms of the Original Lease are incorporated into this Sublease. The Subtenant agrees to assume the obligations and responsibilities of the Sublessor beginning on the Effective Date of this Sublease and continuing until the date of termination.

Landlord Approval
This Sublease is not valid until approved by the Sublessor’s landlord. By signing below, the landlord consents to the subletting of the Premises based on the terms of this Sublease agreement.
