We collect both Personal Information about you in connection with providing the Service to you. We may share your email address, name, and IP address with Amplitude to help us better analyze the traffic of the Service. By using the Service, you agree that we may use third-party services such as Google Analytics and Amplitude to help us analyze the traffic to the Service. We do not process your Personal Information except as required to provide the Service to you, as specified in this policy, with your consent, or as otherwise permitted by law. We will not collect additional categories of Personal Information or use the Personal Information that we collect for materially different, unrelated, or incompatible purposes without providing notice to you.

Use and Disclosure of Non-Personal Information

We reserve the right to use and disclose Non-Personal Information, such as anonymous, statistical, or aggregated data, for any purpose and to share it with any third party at our sole discretion. Such aggregated data does not allow any party to identify you or any other specific user, and is not Personal Information subject to this Privacy Policy.

Security

Your connection to the Service is secure and encrypted using SSL (Secure Sockets Layer), which is the standard "secure" connection used in the HTTPS protocol.

We host information about you in a secure server and cloud-based environment provided by Amazon.com, Inc. ("AWS"). AWS takes top security measures in order to ensure safe retention and storage of Personal Information. Despite these measures, however, you should know that we cannot fully eliminate security risks associated with your information. You are responsible for all uses of the Service by any person using your account.

We do not process Personal Information for automated decision-making or profiling purposes in a manner restricted by the GDPR.

We rely on the following lawful grounds under the GDPR to process your Personal Information: (a) it is necessary for the performance of a contract with you; (b) our or a third-party’s legitimate business interest; or (c) your consent.

Data Transfer Notice.

We are located in the United States and transfer your Personal Information for processing in the United States. We make the transfer to the United States in the absence of an adequacy decision because it is necessary for the performance of a contract with you, or with your consent.

Data Retention; Opt-Outs

In general, we will retain your information for as long as your account is active or as needed to provide you with the Service. We will retain and use your information as necessary to comply with our legal obligations, resolve disputes, and enforce our agreements.

For users accessing the Service from the EU: In accordance with the EU’s General Data Protection Regulation, we delete, anonymize, or erase Personal Information once such information is no longer needed for its original processing purpose, or the impacted person has withdrawn his/her consent and there is no other reason for justification for the processing, or erasure is required to fulfil a statutory obligation under the EU law or the right of the Member States. You acknowledge and agree that SignWell shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, goods or services available on or through any such third-party website.

We strongly advise you to read the terms and conditions and privacy policies of any third-party website that you access through a link available in the Service.

Children's Privacy

Only persons aged 18 or older have permission to access our Service. We do not knowingly collect Personal Information from anyone under the age of 18. If you are a parent or guardian and you learn that your child has provided us with Personal Information, please contact us immediately. If we become aware that we have collected Personal Information from anyone who is under 18 without verification of parental consent, we will take steps to remove that information from our servers.

Changes to Privacy Policy

We reserve the right, at our sole discretion, to modify or replace this Privacy Policy at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

Regarding Our Exemption From International And State Data Privacy Laws

As of the “Last Updated” date indicated on this page, SignWell is not subject to the state-level data privacy laws in the United States (including, without limitation, those affected in Colorado, Connecticut, Delaware, Indiana, Iowa, Oregon, Tennessee, Utah, and Virginia).
